Terms & Conditions

Everything you need to know about shopping with Electrily.

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Electrily website located at www.electrily.co.uk (the “Website”) and any purchase of products made through it. Please read these Terms carefully before placing an order.

By accessing our Website and/or placing an order, you confirm that you accept these Terms and agree to be bound by them. If you do not agree, you must not use our Website or purchase from us.

These Terms apply to all contracts between Electrily Ltd and you (the “Customer”) for the sale of goods via our Website. They apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice, or course of dealing.

2. About Us

Electrily Ltd is a company registered in England and Wales.

We operate exclusively as an online retailer. We do not operate any physical retail premises open to the public.

3. Our Products

Electrily Ltd sells consumer electrical products via our Website, including but not limited to:

  • Remote Control (RC) Cars and vehicles
  • Electric Bikes (eBikes)
  • Electric Scooters (eScooters)
  • Electric Skateboards (eSk8/eSkateboards)

We operate as a drop-shipping retailer. This means that upon receipt of your order, goods are dispatched directly to you from one or more of our approved third-party suppliers. This does not affect your statutory rights or our obligations to you as a consumer under UK law.

Product images shown on our Website are for illustrative purposes only. While we make every effort to accurately display products, slight variations in colour, size, or appearance may exist due to screen settings or photography.

All product descriptions, specifications, and prices are subject to change without notice. We reserve the right to discontinue any product at any time.

4. Eligibility and Geographic Restrictions

By placing an order, you confirm that:

  • You are at least 18 years of age;
  • You are a consumer purchasing for personal, non-commercial use;
  • You are ordering for delivery to an address within the United Kingdom (England, Scotland, Wales, and Northern Ireland);
  • You have the legal capacity to enter into a binding contract.

We currently ship to UK addresses only. We do not accept orders for delivery to addresses outside the United Kingdom. If you attempt to place an order for international delivery, we reserve the right to cancel and refund your order.

5. Placing an Order

5.1 How to Place an Order

All orders must be placed through our Website at www.electrily.co.uk. We do not accept orders by telephone, email, post, or any other method.

5.2 Order Confirmation

After placing an order, you will receive an automated order acknowledgement email to the email address you provided. This acknowledgement does not constitute acceptance of your order; it simply confirms we have received it.

A legally binding contract between you and Electrily Ltd is formed only when we send you a dispatch confirmation email confirming that your goods have been sent.

5.3 Our Right to Refuse or Cancel Orders

We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to situations where:

  • A product is out of stock or unavailable from our supplier;
  • There is an error in the price or product description on our Website;
  • We are unable to verify your payment;
  • The order appears to be fraudulent or placed in bad faith;
  • The delivery address is outside the United Kingdom.

If we cancel your order after payment has been taken, we will issue a full refund within 14 days using your original payment method.

5.4 Accuracy of Information

You are responsible for ensuring the accuracy of all information you provide when placing an order, including your name, delivery address, and contact email. We cannot accept responsibility for non-delivery or delays resulting from incorrect information provided by you.

6. Pricing and Payment

6.1 Prices

All prices displayed on our Website are in pounds sterling (GBP) and are inclusive of VAT where applicable. Delivery charges are not included in the product price and will be shown separately at checkout before you confirm your order.

We take all reasonable care to ensure prices are correct at the time of publication. However, if we discover an error in the price of a product you have ordered, we will contact you and give you the option to continue at the correct price or cancel your order for a full refund.

6.2 Accepted Payment Methods

We accept all major online payment methods, including but not limited to:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • PayPal
  • Apple Pay and Google Pay
  • Any other payment methods displayed at checkout

We do not accept cash, cheques, bank transfers, or any form of offline payment. Payment must be made in full at the time of placing your order. We do not offer credit terms to consumers.

6.3 Payment Security

All payment transactions are processed via secure, encrypted payment gateways. Electrily Ltd does not store your full card details on our systems. By submitting payment details, you confirm you are authorised to use the payment method provided.

7. Delivery

7.1 Delivery Options

We currently offer the following tracked delivery options to UK addresses:

  • Standard Delivery: 3 to 5 business days
  • Next Day Delivery: next business day (subject to cut-off times shown at checkout)

All deliveries are fully tracked. Tracking information will be provided in your dispatch confirmation email so you can monitor your order.

7.2 Delivery Timeframes

Delivery timeframes are estimates only and are not guaranteed. Timeframes begin from the point of dispatch, not from the time your order is placed. As we operate a drop-shipping model, dispatch may occur directly from our supplier and may take 1 to 2 business days from order confirmation before shipment.

We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to courier delays, adverse weather, industrial action, or supply chain disruptions.

7.3 Failed Delivery

If a delivery attempt is unsuccessful, the courier will leave a card or send a notification with instructions on how to rearrange delivery or collect your parcel from a local depot. If goods are not collected or redelivery is not arranged within the courier’s holding period, the goods may be returned to our supplier. In such cases, you may be charged for the cost of re-delivery.

7.4 Risk and Title

Risk in the goods passes to you upon delivery. Title (ownership) of the goods passes to you once we have received full payment.

8. Returns, Refunds, and Cancellations

8.1 Your Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 calendar days of receiving your goods without giving any reason.

To exercise your right to cancel, you must notify us clearly in writing within the 14-day cancellation period by emailing contact@electrily.co.uk, stating your order number and your intention to cancel.

8.2 Returning Goods

Following cancellation, you must return the goods to us (or our nominated supplier) within 14 days of notifying us. Goods must be returned:

  • In their original, unused condition;
  • In original packaging, with all accessories, manuals, and components included;
  • With proof of purchase.

You are responsible for the cost of returning goods unless they are faulty or not as described. We strongly recommend using a tracked return service, as we cannot accept responsibility for items lost in transit.

8.3 Refunds

Once we (or our supplier) have received and inspected the returned goods, we will process your refund within 14 days using your original payment method. We reserve the right to make a deduction from your refund if the goods have been used, damaged, or returned incomplete.

We will refund the standard delivery cost paid at the time of ordering. If you selected an upgraded delivery option, only the cost of standard delivery will be refunded.

8.4 Faulty or Damaged Goods

If your goods arrive damaged, defective, or not as described, please contact us at contact@electrily.co.uk within 30 days of receipt. You will be entitled to a full refund, repair, or replacement in accordance with your rights under the Consumer Rights Act 2015.

Please include photographic evidence of any damage or fault where possible to assist us in resolving your issue promptly.

8.5 Exceptions to the Right to Cancel

The right to cancel does not apply to goods that have been:

  • Sealed for hygiene or safety reasons and have been unsealed after delivery (where applicable);
  • Customised or made to your specification.

9. Warranty and Manufacturer Guarantees

Many of our products are sold with a manufacturer’s warranty. The terms, duration, and coverage of any manufacturer’s warranty vary by product and brand and will be detailed in the documentation supplied with your goods.

All warranty claims must be made directly to the relevant manufacturer in accordance with the warranty documentation provided. Electrily Ltd does not administer manufacturer warranty claims on behalf of third-party manufacturers.

Nothing in this clause affects your statutory rights under the Consumer Rights Act 2015, including your right to expect goods to be of satisfactory quality, fit for purpose, and as described. These rights are in addition to any manufacturer’s warranty.

If you are unsure how to make a warranty claim or cannot locate the relevant manufacturer’s contact details, please email us at contact@electrily.co.uk and we will assist where we reasonably can.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Electrily Ltd’s total liability to you arising from or in connection with these Terms or any purchase shall not exceed the total price paid by you for the goods in question.

We shall not be liable for any indirect, consequential, incidental, or special loss or damage, including loss of profit, loss of use, or loss of data, arising out of or in connection with your use of our Website or the purchase of goods.

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability which cannot be excluded or limited under UK law.

We are not responsible for damage caused by misuse of products, failure to follow manufacturer instructions, or use of products for purposes for which they were not designed.

11. Product Safety and Compliance

All products sold by Electrily Ltd are intended for use in accordance with the manufacturer’s instructions and applicable UK law. Some of our products (including eBikes, eScooters, and eSk8boards) may be subject to specific legal regulations regarding their use on public roads, pavements, or cycle paths.

It is your sole responsibility to ensure that you comply with all applicable laws and regulations regarding the use of electric vehicles and motorised equipment in your jurisdiction. Electrily Ltd does not provide legal advice and accepts no liability for any fines, penalties, or consequences arising from your use of products in a manner that contravenes applicable law.

Always wear appropriate safety equipment when using electric vehicles and follow all relevant road traffic and safety legislation.

You agree to use our Website only for lawful purposes. You must not:

  • Use our Website in any way that breaches applicable local, national, or international laws or regulations;
  • Transmit any unsolicited or unauthorised advertising or promotional material;

  • Attempt to gain unauthorised access to our Website, servers, or databases;
  • Use automated tools to scrape, crawl, or harvest data from our Website.

We reserve the right to suspend or terminate your access to our Website at any time without notice if we believe you have breached these Terms.

We recommend that you review these Terms periodically to ensure you are aware of any updates.

17. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining Terms, which shall continue in full force and effect.

18. Entire Agreement

These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement between you and Electrily Ltd in relation to the purchase of goods from our Website and supersede all prior agreements, representations, or understandings.
